Filing an Agreement

A written agreement sets out what both parties have agreed to for child and/or spousal support payments. To enrol with BCFMA, the agreement must be signed by both parties and filed in Provincial or Supreme Court.

How to File an Agreement in Provincial Court

  1. Complete the Request to File an Agreement (Form 26)
    • Fill in the box for the parts of the agreement you would like BCFMA to administer
    • You can select more than one box
      • Select Section 148 (2) if the agreement specifies child support
      • Select Section 163 (3) if the agreement specifies spousal support
  2. Print or make copies of the completed form and written agreement
  3. You can submit the forms in person, by mail or by fax to the court registry
    • The registry where you file the documents must be:
      • The location where an existing case between you and the other party is filed
      • The location closest to where the child lives most of the time, if the case involves a child or children
      • The location closest to where you live, if there are no children involved in the case
  4. The registry clerk will review your package to ensure it is complete and stamp a court file number on the agreement. You will be given a copy for your records
  5. Make a copy of the stamped filed agreement and submit it to BCFMA

How to File an Agreement in Supreme Court

  1. Complete the Form F17.1 Requisition
  2. Print or make copies of the completed form and written agreement
  3. Take these forms and the filing fee to the courthouse
    • The registry where you file the documents can be:
      • The location where an existing case between you and the other party is filed
      • The location closest to where you live, if there is no existing filed case
    • Note that fees can change so it’s best to call the registry or check the Supreme Court rules in advance to verify the amount
  4. The registry clerk will review your package to ensure it is complete and stamp a court file number on the agreement. You will be given a copy for your records
  5. Make a copy of the stamped filed agreement and submit it to BCFMA
